FIRST: Background

ASESORÍAS INTEGRALES Y DESARROLLO TECNOLÓGICO LIMITADA, hereinafter CKAPATUR LTDA, is the owner of the software, brand and other copyrights and intellectual property of the platform called "TIKTUR".

TIKTUR is a technological platform, which includes the Application and the Website, as well as any subdomain thereof, as well as any other website through which TIKTUR services are made available for the purchase and sale of tickets and other products associated with tourist services of various kinds, such as access to tourist visitation sites, guided tours, accommodation, gastronomy and/or transportation, standing out for their design, speed and security in the provision of said service. In turn, it includes applications for smartphones, tablets and other smart devices, as well as application program interfaces and all associated services. Hereinafter, the Website, the Application, Software and the TIKTUR Services will be jointly referred to as the "TIKTUR Platform", either with its current name or with any other name with which it may appear in the future.

TIKTUR is the exclusive property of CKAPATUR LTDA, sole taxpayer number 77.443.248-5, with address at Baquedano 239, Office No. 316, commune of Antofagasta, Antofagasta Region and is legally represented by Mr. Jorge Antonio Olivares Ávila and Mrs. Lorna Angélica Donoso Olivares.

This instrument regulates the use of the website www.tiktur.com and of all the subdomains of said site and also the scope of the provision of services carried out by the TIKTUR Platform to the Buyer or User.

CKAPATUR LTDA acts as agent, that is, on behalf of and by order of the "Administrator" of the tourist service, providing the latter with ticket sales services. The Administrator is responsible for the administration and organization of the tourist service, in a timely manner and in accordance with the law, with CKAPATUR LTDA acting only as its agent.

CKAPATUR LTDA respects current legislation in the exercise of its business, especially Law No. 19,628 on Protection of Private Life and Law No. 19,496 on Protection of Consumer Rights.

SECOND: Acceptance of the Terms and Conditions

The Buyer or User, when registering and/or creating a profile on the Website, in order to purchase tickets for tourist services, must previously and fully accept the Terms and Conditions established on our Website. The Terms and Conditions may be updated periodically, governing the modifications only for the tourist services that are published by the Administrator of the tourist service after the aforementioned notification. From that moment on, the document that is available on the Website will be understood to be updated.

In view of the foregoing, we recommend that our Users review the Terms and Conditions frequently and, in any case, always before making a purchase of tickets, so that, if they do not agree with them, they desist from using our website. service.

THIRD: Conditions of Use of the TIKTUR Platform

To use our TIKTUR Platform, the User will first create a profile for exclusively personal use. To create the User profile, personal data is requested that the User must provide. The User guarantees and declares in this act the veracity, accuracy and validity of their data. The User will be liable for the damages caused by the breach of the aforementioned obligations.

It will be the sole responsibility of the User to keep their information updated on the TIKTUR Platform. The User is solely responsible for the accuracy of the information provided at the time of registering their profile.

The User's account is personal, private and non-transferable. For no reason should you allow anyone other than yourself to access this site with your account, nor share your secret key with third parties. By making use of the password assigned to the User's account, it is presumed that the person entering is effectively the User and not another. The User must strictly comply with the aforementioned Terms and Conditions.

In the event that the User forgets his password, TIKTUR may modify it by assigning a new one. For this, encryption methodology will be used. After the change has been made, TIKTUR will inform the User of his new password so that he can freely choose another one, modifying the one assigned by TIKTUR.

TIKTUR may require additional information from the User for a specific tourist service in which the User wants to participate. In these cases, the information will be requested at the time of purchasing the ticket through the Website. The information provided by the User will be stored for the sole purpose of delivering it to the Administrator. CKAPATUR LTDA is responsible for this information only being received by the Administrator of the tourist service and undertakes to keep it protected. TIKTUR uses the highest technology to protect the personal information of Users, however, we inform you that, to date, there is no mechanism that is completely immune to cyber attacks by third parties seeking to intercept or obtain information in a way illegal or unauthorized.

FOURTH: Conditions of Sale

One of the lines of business of CKAPATUR LTDA is the sale of tickets and products associated with tourist services of various kinds through the TIKTUR Platform. In order to purchase the tickets you must go to www.tiktur.com, where you can find the offer of tourist services, the reservation calendar and the prices of the different tickets.

The final price of each ticket purchased through TIKTUR will be made up of the following concepts:

Base price of the ticket according to the type of ticket chosen by the User;

Charge for service charged by TIKTUR for the selected tourist service. The service charge is charged for each of the tickets purchased and corresponds to the ticket sales service granted by TIKTUR.

The Administrator will set the Base Price of the tickets, as well as the characteristics of the tourist service and the place of its realization. In the same way, the Administrator guarantees the correct execution of the tourist service and its safety.

The User must review the details of their purchase before confirming it and, later, only if they agree with all the information provided, finalize the purchase of the ticket.

TIKTUR, by virtue of the provisions of article 3 letter b) of Law No. 19,496 on the Protection of Consumer Rights, expressly informs that no changes, refunds or returns will be made by the sole will of the Buyer once the purchase process by the Buyer who acquires one or several tickets for a tourist service, that is, there is no right of withdrawal.

At TIKTUR you can buy your ticket through Webpay Plus (online payment) and Transbank POS Equipment (face-to-face payment).

The transaction will be subject to the verification of the User's data by the bank or other entity, as appropriate.

Each registered person is limited to the purchase of 12 tickets for each tourist service, unless there is another maximum limit established by the Administrator, which will be informed in a timely manner.

We reiterate that before confirming the purchase through the TIKTUR Platform, the User must carefully check that their personal data is correct, that they are up to date and that the data of the tourist service, in which they wish to participate, exactly coincide with their interests. We also reiterate that no changes, returns or refunds of tickets are made by the sole will of the User, except as established in the seventh clause on the Ticket Return Policy.

FIFTH: On the Delivery of Tickets

Once the purchase of the ticket(s) by the User is confirmed, the corresponding ticket will be sent to their email, according to the information that the User provided at the time of registration. Each ticket contains a “QR” code or another code of its own, which will be validated at the control point of the tourist service.

The User can print their ticket or present it from their smartphone, in order to access the tourist service.

A “ticket” will be understood as the voucher received by the Buyer in his email, which contains a “QR” code that grants him the right of admission to the tourist service.

The ticket can be printed as many times as necessary, without prejudice to the fact that the code used to access the tourist service is unique and can be validated only once prior to the provision of the tourist service.

SIXTH: Characteristics of the Ticket

Tickets are purchased through the website www.tiktur.com. These tickets are valid only for the day, time and tourist service that they specify, and cannot be used for other tourist services no matter how similar they may be. The only exception to the provisions above will be given in the event that the tourist service is postponed, which will be promptly informed to the Users, who may choose to: (i) use the ticket on the date that is scheduled to replace the one that was cancelled; or, (ii) request the return of the total value paid for the ticket.

After verifying the code at the tourist service control point, the same code cannot be used again.

Tickets are non-refundable, unless allowed by the Administrator or a postponement or cancellation of the tourist service occurs according to the policies established in these Terms and Conditions.

SEVENTH: Ticket Refund Policy

TIKTUR, by virtue of the provisions of article 3 letter b) of Law No. 19,496 on the Protection of Consumer Rights, expressly informs that no changes, refunds or returns will be made by the sole will of the Buyer after 10 days from the end of the purchase process by the Buyer who acquires one or several tickets for a tourist service, that is, there is no right of withdrawal after said period.

The only exceptions are those requests for refunds that are made for well-founded and verifiable reasons and that result in the User being absolutely unable to participate in the tourist service. Said situations can be work trips, medical licenses, illness of the User, death of a close relative, up to the second degree of consanguinity, among others. It is the Administrator, not CKAPATUR LTDA, who has the power to accept or not the return of a person's ticket for a specific tourist service. The User must communicate with CKAPATUR LTDA up to 72 hours before the provision of the tourist service through e-mail returns@ckapaturchile.cl. CKAPATUR LTDA will send your request to the Administrator and then communicate the resolution to the Client. If the refund is approved by the Tourist Service Administrator, it will be made within a period of approximately 60 calendar days. The reversal will be made according to the means of payment used by the Client, in accordance with the provisions of this clause. The refund includes the Base Price of the ticket plus the Service Charge.

The aforementioned is without prejudice to the cases of return of tickets due to cancellation of the tourist service, modifications of date, time, place or others that differ from what was originally informed to the Buyer. If the tourist service is modified or postponed to another date and time, the Buyer may choose between: (i) keeping their original ticket, which will be valid for the postponed tourist service; or, (ii) the return of the total price of the ticket (which includes the Base Price plus the Service Charge) according to the terms explained in the following paragraph.

The Administrator must authorize the return of the net amounts collected for tickets, through the TIKTUR Platform. The Administrator must indicate to CKAPATUR LTDA the procedure to follow to make the correct return of the money to the Clients, which will be published immediately so that the User has clarity in the way in which he must proceed so that the money is reversed. . From that communication, both the Base Price of the ticket and the Service Charge will be refunded, that is, the entire price paid by the User, depending on how the ticket was paid. If it was through a credit card, it will make the reverse through the means of payment used to your credit card; if it was paid by debit card, it will be reimbursed by electronic transfer, after verifying the identity of the Buyer of the corresponding tickets; and if you made the purchase by another means of payment, the money will be refunded to the account used by that means. In exceptional cases in which the means of payment does not work for reasons beyond our control, the reversals will be made by electronic transfer to the Client's account. The term that CKAPATUR LTDA has to make the return or reverse of the money, is approximately 60 calendar days, counted from the date on which the User requested the return due to the cancellation, suspension or modification of the tourist service, always and when the User delivers the necessary information to carry out the reverse of the money.

CKAPATUR LTDA will not have any relationship as agent regarding the tickets sold or delivered directly by the Administrator of the tourist service without using the TIKTUR Platform, or that have been delivered by a third party unrelated to CKAPATUR LTDA as part of a contest, invitation, courtesy or other similar. The returns of these tickets must be coordinated with the institution or company that delivered them, leaving CKAPATUR LTDA exempt from any responsibility that derives from it.

EIGHTH: Copyright

Participants may be registered at the control point of the tourist service for security reasons. In the event that, after registration, it is verified that a participant is carrying bladed weapons, alcohol or another that affects the security of the tourist service, their access to it will be prevented.

CKPATUR LTDA may have content from third parties, that is, content from legal or natural persons other than the Administrator, on its platform or with links to third party sites. CKAPATUR LTDA has no influence on the content provided or published by said third parties on the TIKTUR Platform. In cases where information from third parties is published, CKAPATUR LTDA will warn the Administrator who has delivered the information, about the need to have the respective authorization in order to protect the copyright of those third parties.

NINTH: Data Protection and Privacy Policy

The use of the personal data informed by the User in his profile must be previously consented by him and will have the following purposes: (i) Validate the ticket purchase orders; (ii) Improve the information and marketing of the products and services provided by CKAPATUR LTDA; (iii) Feed the TIKTUR database in order to perform automated data processing for consumption analysis by the Tourist Service Administrator; (iv) Propose improvements around the User experience regarding the tourist services in which they participate; and, (v) Used for commercial purposes of CKAPATUR LTDA and the Administrator of the tourist service for which the Client purchased a ticket

The transfer of personal information to third parties without prior authorization by the User is prohibited, that is, to legal or natural persons other than the Administrator or CKAPATUR LTDA.

TIKTUR uses the highest technology to protect the personal information of Users, however, we inform you that, to date, there is no mechanism that is completely immune to cyber attacks by third parties seeking to intercept or obtain information in a way illegal or unauthorized.

The User may always exercise their rights of access, rectification, cancellation and opposition to the processing of their personal data. The foregoing will be made effective by means of a written communication, attaching a photocopy of your national identity card or equivalent identification document, to the email contacto@ckapaturchile.cl.

TIKTUR does not store information related to the User's means of payment, nor does it carry out a validation process of the information that the User registers in his profile, so it is the User's responsibility that this information is updated and truthful. In the event of inconveniences directly related to the means of payment, the User must resort to the corresponding banking entity, and CKAPATUR LTDA may provide all the help that the User needs to solve the inconvenience with said entity.

The Client authorizes CKAPATUR LTDA to carry out promotional and/or advertising communications of products associated with tourist services of various kinds, such as access to tourist visitation sites, guided tours, accommodation, gastronomy, transportation or other, of which CKAPATUR LTDA is find related. In the event that the Client does not wish to receive communications, they may request their cessation by sending an email to contacto@ckapaturchile.cl, expressing his refusal.

TENTH: Use of Cookies and Security

TIKTUR's data server will send data to the Client's browser so that they are stored on the hard drive of their computer and allow us to identify the computers used by Clients when accessing our Platform, this process is known as the use of "cookies". ” or “IP addresses”. Through the use of "cookies" or "IP addresses" TIKTUR can offer a more personalized service to its Users since it allows us, among other things, to offer advertising and promotion campaigns, measure the size of our audience and the flow of traffic in the different sites that the User visits.

CKAPATUR LTDA does not guarantee the privacy and security of the use of the TIKTUR Platform and, in particular, does not guarantee that unauthorized third parties may not be aware of the class, conditions, characteristics and circumstances of the use that Users make of the TIKTUR Platform. Due to the foregoing, CKAPATUR LTDA. is exempted, to the full extent permitted by law, from any liability for damages of any nature that may be due to the knowledge that unauthorized third parties may have of the class, conditions, characteristics and circumstances of the use that users make of the TIKTUR Platform.

ELEVENTH: Responsibility

CKAPATUR LTDA is responsible for the website www.tiktur.com and for the purchase of tickets through it. The Administrator of the tourist service will make available to the Users all the necessary information so that they have a complete understanding of the tourist service, in particular, it will inform regarding the type of tourist service, the place where it will be developed, the date, the time, the location, etc. The Administrator will be responsible for the lack of veracity, accuracy and validity of the information that he makes about his tourist service.

CKAPATUR LTDA undertakes to review the website www.tiktur.com and the tourist services published in it on a frequent basis. In case of seeing any error, CKAPATUR LTDA will immediately inform the Administrator so that he changes the information as soon as possible and thus avoid damages to the Users. We also request Users that in case of observing any error on the website www.tiktur.com inform us by e-mail contacto@ckapaturchile.cl.

CKAPATUR LTDA uses the highest technology to safeguard its TIKTUR Platform, which does not absolutely prevent third parties from infecting or damaging the Website.

TWELFTH: Responsibility for Tourist Service

CKAPATUR LTDA acts as the representative of the Tourist Service Managers and is responsible for the sale of tickets and associated products through its TIKTUR Platform. That is why the Administrator is directly responsible for what happens during the provision of the tourist service, whatever it may be, for its cancellation or postponement and for the safety of the participants. CKAPATUR LTDA has no responsibility in any area related to the tourist service and is only responsible for the Website and the sale of tickets through it. In case of problems during the provision of the service, whatever they may be and that are not related to the ticket, please contact the Administrator of the same. If you have problems and cannot communicate with the Tourist Service Administrator, you can send us an e-mail to contacto@ckapaturchile.cl and we will forward your comments or complaints to the Service Administrator.

The Administrator is the one who executes the ticket validation process in the place where the service is developed.

THIRTEENTH: Inactivity of the TIKTUR Platform

The TIKTUR Platform may be inactive in the following cases:

Scheduled maintenance: which consists of the scheduled stoppage of the service in order to carry out its maintenance.

Force Majeure: For the purposes of this instrument, those circumstances that could not have been foreseen, or that, foreseen, were unavoidable, and that prevent the fulfillment by the affected party of their respective obligations under the Terms and Conditions, will be considered as cases of force majeure. The foregoing, in accordance with the provisions of article 45 of the Civil Code.

Concurring with the requirements of article 45 of the Civil Code, the following events, among others, may be invoked as causes of Force Majeure: (i) Outbreak of war, declared or not, military invasion or armed hostilities; (ii) Outbreak of a riot, insurrection, commotion or civil war; (iii) Acts of piracy; (iv) Earthquake of a magnitude greater than 7.0 degrees on the Richter scale, volcanic eruption, hurricane, flood or other natural disasters; (v) Accidents derived directly from an event of Force Majeure; (vi) Outbreak of a serious disease or epidemic, quarantine or other public health emergency; (vii) Strikes, stoppages or any type of labor conflict, legal or illegal, that affects the operation of the system; (viii) Viruses; (ix) Network connectivity errors, or any other cause of service unavailability that is beyond the reasonable scope or control of CKAPATUR LTDA.
